Sennheiser electronic SE & Co. KG, Am Labor 1, 30900 Wedemark, Germany (hereinafter referred to as ‘’Sennheiser’’) warrants to  the customer (hereinafter referred to as ‘’Customer’’) in accordance with the following provisions (hereinafter referred to as ‘’Warranty Terms and Conditions’’) that the professional Sennheiser audio products (hereinafter referred to as ‘’Product’’) will be free from defects related to manufacturing, parts, material or workmanship under normal and accepted use for a period of 24 months beginning from the date of purchase of any new Product from an authorized retailer (hereinafter referred to as ‘’Warranty Period’’, the warranty according to these Warranty Terms and Conditions referred to as “Sennheiser Warranty”). Statutory warranty rights are not affected by this Sennheiser Warranty.
 
1.1  The Sennheiser Warranty covers the Sennheiser professional audio products listed on https://spares.sennheiser.com/catalog (hereinafter referred to as ‘’Sennheiser Product Catalog’’). For any Sennheiser consumer audio products please contact Sonova Holding AG (http://www.sennheiser-hearing.com).
 
1.2  These Sennheiser Warranty covers any defects related to manufacturing, parts, material or workmanship. The Sennheiser Warranty covers defects arising under normal use only.
 
1.3  The following parts are not covered by the Sennheiser Warranty: 
  • Rechargeable and disposable batteries.
  • Ear bud covers. 
  • Ear cushions and/or headphone padding.
  • Cable clips. 
  • Foam microphone windscreens.
  • Cases.
  • Any other parts or accessories which are subject to regular wear and tear.
 
1.4 The following cases are not covered by the Sennheiser Warranty:
 
  • Minor defects or deviations in the quality of the Product which does not affect the Product’s value or fitness for its intended purpose.
  • Defects resulting from improper use (e.g. operating errors, mechanical damage, incorrect operating voltage). Proper use for the purposes of this Warranty Terms and Conditions is defined as use of the Product under the conditions stated in the instructions for use.
  • Any utilization of the Product that is inconsistent with either the design of the Product or the way the manufacturer intended the Product to be used.
  • Malfunction of the Product caused by a conflict or incompatibility between software applications installed on the defective Product or on the hardware with which the Product continuously interacts.
  • Defects due to wear and tear.
  • Damage or inoperability caused by inadequate repair work performed by the Customer or any non-authorized repair center.
  • Any modification of the Products effected by the Customer or a third party, unless Sennheiser has given its prior written consent to the nature and extent of the modification.
  • Defects due to force majeure.
  • Defects of which the purchaser was already aware at the time of purchase.
  • Products where the identification label, serial number or safety label has been removed or altered.
  • The Product has been exposed to liquids or chemicals of any kind and/or extreme temperatures, moisture or humidity.
  • Counterfeit products or products which are purchased through distribution channels that are not authorized by Sennheiser.
 
1.5 Sennheiser undertakes to remedy the defect at its own discretion and expense by repair or by replacement with new or refurbished parts. All original parts that have been replaced as part of the service provision become the property of Sennheiser. The new parts or replacement parts become the property of the Customer.
 
1.6 Repairs or replacements under this Sennheiser Warranty do not entitle the Warranty Period to be extended or restarted. Repairs and replacements under this Sennheiser Warranty can be carried out with functionally equivalent replacement units.
 
2. Extended Warranty
 
An extended warranty applies for certain products if specified on https://www.sennheiser.com/warranty-conditions. In case the extended warranty applies, the Warranty Period is extended to the period specified for the respective product (usually 5 or 10 years). The extended warranty might be subject to a registration of the Product together with your personal details. All other provisions of these Warranty Terms and Conditions apply accordingly. 
 
3. Limited Warranty
 
Products marked as "C stock” are subject to a limited warranty. C stock are products which may have been/has been opened/taken out of the box, with minimal visible marks of wear but are complete and fully functional. In case the limited warranty applies, the Warranty Period is reduced to 12 months. All other provisions of these Warranty Terms and Conditions apply accordingly.
 
4. Filing of warranty claims
 
4.1  If you wish to file a claim under the Sennheiser Warranty, please visit https://spares.sennheiser.com/catalog and choose your Product. Follow the detailed return instructions. Filing for a claim under the Sennheiser Warranty might be subject to a registration of the Product together with your personal details.
 
4.2 Country specifics: In Brazil you can only file a claim under the Sennheiser Warranty if the Product was purchased in Brazil. If you have purchased the Product outside of Brazil, please contact the Sennheiser customer service in your country of purchase.
 
4.3 Please retain your sales receipt (or your warranty certificate) as proof of purchase. In order to make claims under the Sennheiser Warranty it is required that the Customer encloses the original invoice showing the date of purchase. The serial number of the delivered Product must match the serial number sold to the Customer. Other documents such as inter alia bank statements, credit card statements, PayPal or eBay confirmations, bills of lading, bills of material or other shipping detail documents are not sufficient to prove the eligibility under the Sennheiser Warranty.
 
4.4 Warranty repairs must be carried out according to the process described in these Warranty Terms and Conditions. The cost of repairs not performed according to these Warranty Terms and Conditions will not be reimbursed and the Sennheiser Warranty does not cover repairs or damage that may result from such repairs.
 
5. Limitation of liability
 
5.1 Sennheiser is not liable for the loss of any data. Under the Sennheiser Warranty, Sennheiser is not liable for financial loss, downtime, loan or rental equipment, travel costs, loss of profit or similar. Sennheiser's liability is limited to the purchase value of the Product.
 
5.2 Other claims of the Customer against Sennheiser based on the Sennheiser Warranty, in particular for damages, are excluded.
 
6. Statutory rights and Applicable law
 
The rights of the Customer under the applicable national legislation, i.e. the rights of the buyer against the seller derived from the purchase contract, are not affected by this Sennheiser Warranty. This Sennheiser Warranty applies in addition to the applicable warranty and liability regulations and does not limit the rights of consumers against sellers or other mandatory or non-waivable rights under national or European law in accordance with the law on general terms and conditions. 
 
To the extent permitted by law these Warranty Terms and Conditions are subject to the laws of the Federal Republic of Germany. The UN Convention on Contracts for the International Sale of Goods are not applicable. For consumers, the law of the country in which the consumer is domiciled shall apply to the extent required by law.
 

7. Place of jurisdiction
 
If the Customer is an entrepreneur, all current and future disputes and claims arising from or in connection with this contractual relationship shall be subject to the exclusive jurisdiction of the courts in Hannover/Germany and, at our discretion, the Customer’s general place of jurisdiction. In all other cases, Sennheiser or the Customer may bring an action before any court having jurisdiction by law.
 
8. Severability clause
 
If any provision of these Warranty Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall not be affected.
